26th May 2023, Skopje – More efficient and timely construction of facilities of strategic interest to the country is the goal set within the amendments to the Law on Expropriation and the Law on Establishing Public Interest and Nominating a Strategic Partner for Implementation of the Project for the Construction of Road Corridor 8 (Tetovo- Gostivar – Bukojchani motorway section and the Project for Trebenishta-Struga-Qafasan Motorway) and Road Corridor 10d (Prilep-Bitola motorway section) in the Republic of North Macedonia, being adopted today by the Parliament of the Republic of North Macedonia.
Both legal solutions are aimed at speeding up the implementation of all strategic projects and their realization within the shorter time period, thus entailing lower costs therefor. It is a matter of legal amendments, which are not only aimed at these two Projects, but they are rather applied to all strategic projects of public interest.
“These legal solutions will apply to all projects, being intended not only for the infrastructure of the motorway sections along Corridors 8 and 10d, while also regulating matters pertaining to protection of the rights of citizens guaranteed by Constitution. They do not imply any innovation, but it is rather a matter of additional specification of the existing legal provisions, which could not be implemented in practice so far, thus postponing the project implementation”, Minister of Finance, Fatmir Besimi said.
Amendments to the Law on Expropriation provide for simplifying the procedure pertaining to evidence on funds projected for compensation for expropriated real estate in the expropriation procedure, facilitating and speeding up the expropriation process for the purpose of construction of facilities of strategic interest, in particular to pay adequate lease fee in case when the owner lives and performs an activity, as well as in the case of illegal buildings subject to expropriation, wherein natural persons live, in order to allow them to promptly leave the facilities subject to expropriation, all to the end of enhanced efficiency in implementing projects of strategic interest.
In addition, the respective amendments provide for improved implementation of the Law in Practice, pertaining to all projects, which are to be realized in future.
Amendments to Law on Expropriation and the Law on Establishing Public Interest and Nominating a Strategic Partner for Implementation of the Project for the Construction of Road Corridor 8 (Tetovo- Gostivar – Bukojchani motorway section and the Project for Trebenishta-Struga-Qafasan Motorway) and Road Corridor 10d (Prilep-Bitola motorway section) in the Republic of North Macedonia are geared towards accelerated and smooth implementation of projects of public interest, increased Budget liquidity and higher economic growth. These amendments are aimed at reducing the costs for goods and services for the objectives foreseen in the Corridor 8 and 10d Motorway Project, as well as accelerated implementation thereof.
Both Projects imply rounding-up of the investments along Corridors 8 and 10, providing for full serviceability, as well as maintenance of the road infrastructure soundness, thus positioning the country as an inevitable transport route and part of the European corridors. This is part of the country’s transport policies, which are based upon integration with the region, as well as ties and connections of the countries in the region with the EU Member States, i.e. strategic commitment adopted under the National Transport Strategy 2018-2030.
